ORDER : 1. In pursuance of the notice issued by this Court, the corpus Sua Kumari appeared yesterday before us. 2. After perusing the school certificate (Annex.2) issued by the Govt. Upper Secondary School, Jhabra, Jaisalmer, the corpus Sua Kumari was sent to Balika Grah, Jodhpur because as per her date of birth, she is minor. As per the orders passed by this Court on yesterday, the corpus Sua Kumari is produced before us. 3. For the reason that the corpus Sua Kumari is minor and she is willing to go with her father-petitioner Narayan Singh, we deem it appropriate to hand over the custody of the corpus Sua Kumari to her father Narayan Singh, present in person in the Court. 4. The Investigating Officer is directed to produce the corpus Sua Kumari before the concerned magistrate for recording her statement under Section 164 Cr.P.C. and after recording her statement, the custody of the corpus may be handed over to the petitioner Narayan Singh, father of the corpus. The petitioner-father is directed not to solemnize the marriage of the corpus Sua Kumari against her desire before attaining 18 years of age. 5. With above observations, the instant habeas corpus petition is hereby disposed of.
