AMOL RATTAN SINGH

body2017
JUDGMENT : AMOL RATTAN SINGH, J. 1. Pursuant to notice having been issued on 11.07.2017, learned counsel for the State has produced in Court today a communication from the Director General of Police, Haryana, addressed to the Commissioners of Police, Panchkula, Gurugram, Faridabad and all District Superintendents of Police in Haryana, stating therein that it has been decided to consider the name of all ex-constables (both male and female) and selected candidates of the disbanded Haryana State Industrial Security Force battalions, as also selected candidates of the year 2004 who were recruited against the posts of 819 Constables in the HAP, for considering them for enrollment as Special Police Officers (SPOs). 2. Vide another communication, also dated 19.07.2017, it has been directed by the Director General of Police, Haryana, that as the enrollment of Special Police Officers is only contractual, with a monthly honorarium of Rs. 14,000/- to be paid to them, the petitioners cannot be considered for enrolment from a previous date and that they can apply afresh for appointment to the allotted seats in the fresh enrolment process on going. 3. Learned counsel for the petitioners submits that though as regards the eligibility of the petitioners for consideration for appointment to the post in question, this petition has been rendered in-fructuous in view of the first letter of the DGP referred to hereinabove, but with the petitioners all being appointed now subsequent to those who have already been appointed, (treating them to be now eligible), though they were co-selectees of the petitioners in the now disbanded Haryana State Industrial Security Force, an issue with regard to seniority could arise, if the date of appointment is considered at any future time for appointment of SPOs as constables. 4. Having considered the above, this petition is disposed of as having been rendered in-fructuous, the immediate issue only being the eligibility of the petitioners with regard to considering them as ex-selectees of the disbanded Haryana State Industrial Security Force, on par with those selectees who had received some training. 5. The petitioners will obviously now apply for appointment as SPOs under the said category. However, if any such situation arises as has been observed herein above, in future, the petitioners would be at liberty to approach the appropriate forum in respect of any such grievance. 6. 5. The petitioners will obviously now apply for appointment as SPOs under the said category. However, if any such situation arises as has been observed herein above, in future, the petitioners would be at liberty to approach the appropriate forum in respect of any such grievance. 6. A copy of this order be given to both, learned counsel for the petitioners and learned State counsel, under the signatures of the Special Secretary of this Court.
