JUDGMENT Pankaj Bhandari, J. - Petitioner has filed this bail application under section 438 of Cr.P.C., 1973 2. F.I.R. No. 175/2017 was registered at Police Station, Khandela, Dist. Sikar for offences under Sections 341, 323, 382/34 & 327 I.P.C. 3. It is contended by counsel for the petitioner that the allegation of demanding of money for buying liquor is on Pintoo. The allegation of beating the complainant is also on Pintoo and Hansraj. The only allegation against the petitioner is that he caught hold of the complainant. 4. It is also contended that the parties have entered into a compromise and complainant has given an affidavit to the fact that the petitioner was not involved in the dispute. 5. Learned Public Prosecutor has opposed the bail application. 6. Considering the fact that Pintoo has been granted bail under Section 439 Cr.P.C., 1973 There is no allegation against the petitioner for demanding money and beating the complainant and complainant has also given an affidavit to the fact that no offence has been committed by the petitioner, I deem it proper to allow the anticipatory bail. 7. The Anticipatory Bail Application is allowed. The S.H.O./I.O./Arresting Authority, Police Station, Khandela, Dist. Sikar, in F.I.R. No. 175/2017, is directed that in the event of arrest of the petitioner he shall be released on bail, provided he furnishes a personal bond in the sum of Rs. 50,000/- with two sureties in the sum of Rs. 25,000/- each to his satisfaction on the following conditions:- (i) . that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) . that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and (iii) . that the petitioner shall not leave India without previous permission of the Court. Bail application allowed.
