ORDER : A.J SHASTRI, J. 1. This application dated 28.7.2017 has been preferred by the applicant, through jail, with a prayer to enlarge him on temporary bail for a period of thirty days, on the premise that on account of the recent heavy rains, the house of the applicant is seriously damaged and the responsibility to cater the need of the family is on the shoulder of the applicant. 2. The applicant is undergoing life imprisonment in connection with the offences punishable under Section 302 read with Sections 120, 326 and 324 of the Indian Penal Code. 3. Pursuant to issuance of Rule, Mr. J.K Shah, learned Additional Public Prosecutor, has submitted the Verification Report dated 4.9.2017, under the signature of Shri D.V Rana, Senior Police Inspector, Sabarmati Police Station, Ahmedabad City along with statement of the wife of the applicant, which is taken on record. In the said statement, the wife of the applicant has stated that merely the roof of the house has been slightly damaged and not the entire house. 4. The Verification Report also indicates that if the applicant is enlarged on temporary bail, there is serious apprehension that he will misuse the liberty. 5. A perusal of the jail remarks indicate that the conduct of the applicant in jail is stated to be good. However, Column No. 18 thereof indicates that one of the co-accused is absconding and in addition thereto, Para.2 of Column No. 2 3 indicates that in the jail itself, with the assistance of another co-accused, a serious crime is committed and, therefore, considering this situation prevailing on record, we are not inclined to grant the prayers made in the application. 6. Hence, the application stands rejected. Rule is discharged.
