ORDER : ABHILASHA KUMARI, J. 1. Rule. Mr. J.K Shah, learned Additional Public Prosecutor, waives service of notice of Rule for the respondents. 2. This application dated 02.09.2017, has been preferred by the applicant, through Jail, with a prayer to enlarge him on temporary bail for a period of thirty days in order to perform the after-death rituals of his grandmother, who has passed away on 08.01.2017 3. The applicant is undergoing life imprisonment in connection with offences punishable under Sections 302, 201 and 114 of the Indian Penal Code and Section 135 of the Gujarat Police Act, 1951. 4. We have perused the averments made in the application as well as the Jail remarks pertaining to the applicant, which indicate that his conduct in Jail is good and on the previous occasions when he was released on temporary bail, he has surrendered on time. 5. However, we also notice that on the date when the grandmother of the applicant passed away, that is, 08.01.2017, as per the Death Certificate, the applicant was enlarged on temporary bail, which is clear from the Jail remarks. He has availed of temporary bail from 02.01.2017 to 16.01.2017, which period appears to have been extended from 17.01.2017 to 31.01.2017 Hence, there was sufficient time available to the applicant to perform the after-death rituals of his grandmother. 6. As the reason stated in the application is not convincing, we are not inclined to grant the prayer made by the applicant. 7. The application stands rejected. Rule is discharged.
