ORDER : ABHILASHA KUMARI, J. 1. Learned advocate for the applicants has moved a draft amendment, which is granted and may be carried out within a period of four days. 2. Rule. Mr. J.K Shah, learned Additional Public Prosecutor, waives service of notice of Rule of the respondent. 3. This application has been preferred by the applicants (original accused Nos. 1 and 3) with a prayer to condone the delay of 215 days that has occurred in filing an application for restoration of Criminal Appeal No. 1636 of 2016 which was dismissed for non-removal of office objections within the period of time stipulated by the order dated 06.12.2016, passed by this Court. 4. Heard Mr. Aamir S. Pathan, learned advocate for Mr. Ashish M. Dagli, learned advocate for the applicants and Mr. J.K Shah, learned Additional Public Prosecutor for the respondent-State of Gujarat and perused the averments made in the application. 5. For reasons stated in the application, we found that sufficient cause has been shown for the condonation of the delay. 6. Hence, the following order: The delay of 215 days that has occurred in filing the application for restoration of the Criminal Appeal, is hereby condoned. 7. The application is allowed. Rule is made absolute.
