ORDER : ABHILASHA KUMARI, J. 1. Rule. Mr. J.K Shah, learned Additional Public Prosecutor, waives service of notice of Rule on behalf of respondent - State. 2. This application 26.8.2017 has been preferred by the applicant, through jail, with a prayer to enlarge him on temporary bail for a period of twenty-one days, in order to immerse the ashes of his grandmother, who is stated to have passed away on 9.9.2013, as per the averments made in the application and copy of the death certificate annexed therewith. 3. The applicant is undergoing life imprisonment in connection with the offences punishable under Sections 302 and 114 of the Indian Penal Code and Section 135 of the Gujarat Police Act. 4. We have perused the averments made in the application as well as the jail remarks pertaining to the applicant, which indicate that his conduct in jail is not good. 5. However, be that as it may, the reason stated in the application does not inspire confidence at all as the grandmother of the applicant is stated to have passed away as long back as on 9.9.2013 and the necessary ceremony would have been over by now. Even otherwise, the presence of the applicant is not necessary. 6. In view of the above discussion, we are not inclined to entertain the application. Hence, the application stands rejected. Rule is discharged.
