JUDGMENT Anil Kumar Choudhary, J. - Apprehending his arrest in connection with Ranka P.S. Case No. 45 of 2017 corresponding to G.R. No. 789 of 2017 instituted under Sections 420 of the Indian Penal Code and 27(b)(ii) of the Drugs and Cosmetic Act,1940, the sole petitioner has moved this Court for grant of privilege of anticipatory bail. 2. Heard learned senior counsel appearing for the petitioner as well as learned Addl. PP for the State. 3. The learned senior counsel appearing for the petitioner submits that on the basis of the pamphlet, which is part of the FIR and is kept at page 23 of the brief, the petitioner has been implicated in this case but the pamphlet does not bear signature of any person nor does it says that who is the printer of the pamphlet and on which date the pamphlet was printed. Hence, it is submitted that the petitioner be given the privilege of anticipatory bail. 4. The learned Addl. PP submitted to call for the case diary. 5. Let the case diary be called for from the Superintendent of Police, Garhwa as well as court concerned and list this case on 01.11.2017. 6. Considering the submissions of the counsels and the fact as discussed above, I am inclined to pass an interim order of anticipatory bail to the sole petitioner provisionally till 01.11.2017. In case of the petitioner being arrested by the police on or before 01.11.2017, shall be released on bail provisionally on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the officer concerned in connection with Ranka P.S. Case No. 45 of 2017 (G. R. No. 789 of 2017 ) subject to the conditions laid down under section 438 (2) Cr. P.C., 1973.
