ORDER : ABHILASHA KUMARI, J. 1. Rule. Mr. J.K Shah, learned Additional Public Prosecutor, waives service of notice of Rule for the respondents. 2. This application has been preferred by the applicant with a prayer to extend the temporary bail granted to him vide the order dated 30.08.2017, passed in Criminal Misc. Application No. 21222 of 2017, by a further period of thirty days. By the above-referred order, the applicant had been enlarged on temporary bail for a period of ten days in order to enable him to provide treatment for dengue fever to his son, who was admitted in the Hospital. 3. In the present application, the applicant states that his son is still seriously ill with dengue fever and anaemia and his treatment is going on. The applicant is required to arrange for finances in order to pay the bills for the treatment. Along with the application, a Certificate dated 06.09.2017, issued by Dr. N.K Parikh, Shreeji Clinic and Hospital, has been annexed. A perusal of the same indicates that the son of the applicant has developed hemorrhagic patches and his platelet count has also been reduced. He may also require a blood transfusion. 4. The applicant is undergoing life imprisonment in connection with of fences punishable under Sections 302, 120B and 326 of the Indian Penal Code, 1860. 5. Having heard Mr. Sandip M. Patel, learned advocate for the applicant and Mr. J.K Shah, learned Additional Public Prosecutor for the respondents, we are inclined to partly grant the prayer made by the applicant. 6. Hence, the following order: The period of temporary bail granted to the applicant vide order dated 30.08.2017, passed in Criminal Misc. Application No. 21222 of 2017, is hereby extended by a further period of seven days on the same terms and conditions. 7. Upon expiry of the aforesaid period, the applicant shall surrender before the concerned Jail authority forthwith. 8. The application is partly-allowed, in the above terms. Rule is made absolute, to the above extent. 9. Registry is directed to send a copy of this order through Fax message to the concerned Jail authority, forthwith. 10. Direct Service of this order, today, is permitted.
