ORDER : M.R. SHAH, J. 1. Having realized that those persons who are likely to be affected if at all the relief as sought for in the present petition is granted ie., removal of encroachment in question are not joined as the party respondents, Shri. Bhunesh Rupera, learned advocate appearing for the petitioners seeks permission to withdraw the present writ petition with a liberty to file fresh petition, after joining the concerned alleged encroachers as the party respondents. 2. Permission is accordingly granted. Writ petition stands dismissed as withdrawn with the above liberty. 3. As and when such a petition is preferred, the same may be considered in accordance with law and on its own merits without being influenced by withdrawal of the present petition.
