ORDER : This Criminal Revision is filed praying to call for the records relating to the Judgment, dated 01.04.2010 made in C.A.No.77 of 2009, on the file of the learned Additional District and Sessions Judge (Fast Track Court), Dindigul, confirming the Judgment, dated 20.11.2009 made in C.C.No.55 of 2006, on the file of District Munsif-cum-Judicial Magistrate Court, Kodaikanal and set aside the same, as illegal. 2. The petitioner and the second respondent are present before this Court along with their respective counsels. The learned Additional Public Prosecutor appearing for the first respondent is also present. 3. The learned counsel appearing for the petitioner and the second respondent would submit that, since the parties have settled their disputes amicably, the defacto complainant, who is the second respondent herein, does not want to continue the criminal proceedings against the petitioner herein. Hence, the petitioner and the second respondent are seeking indulgence of this Court to record the compromise and allow the Revision by setting aside the Judgment, dated 01.04.2010 made in C.A.No.77 of 2009, on the file of the learned Additional District and Sessions Judge (Fast Track Court, Dindigul, confirming the Judgment dated 20.11.2009 made in C.C.No.55 of 2006, by the learned District Munsif-cum-Judicial Magistrate, Kodaikanal. 4. The learned Government Advocate (crl.side) appearing for the 1st respondent states that he has no objection to record the compromise, since the parties to the case compromised the issue between themselves. 5. The learned counsel appearing for the petitioner produced the Original Aadhaar Card of the petitioner and the counsel for the second respondent has produced a Xerox Copy of Family Card, for identification. The Petitioner's Aadhaar Card Number is, 8623 4029 6787 and the second Respondent's Family Card Number is.22/G/0526227. 6. The Court heard the submissions of the respective parties, who appeared before this Court and their identification is also verified by their respective counsels. 7. Since the parties have settled their disputes amicably and they have also filed a ' Joint Memo of Compromise', dated 02.09.2016 to that effect, this Court is inclined to allow the Revision. 8.

Accordingly, the present Revision is allowed, in terms of the 'Joint Memo of Compromise', dated 02.09.2016, and the Judgment, dated 01.04.2010 made in C.A.No.77 of 2009, on the file of the learned Additional District and Sessions Judge (Fast Track Court), Dindigul, confirming the Judgment, dated 20.11.2009 made in C.C.No.55 of 2006, on the file of District Munsif-cum-Judicial Magistrate Court, Kodaikanal, is set aside. The trial Court is directed to refund the fine amount of Rs.1000/- to the petitioner herein. The 'Joint Memo of Compromise, dated 02.09.2016, shall form part of the order.
