JUDGMENT : 1. We have perused the affidavits filed by Shri Akhilesh Kumar Singh, Deputy Commissioner of Police, Zone-III, Mumbai and Dr. Manoj Kumar Sharma, Deputy Commissioner of Police, Zone-I, Mumbai. We regret to state that we are not satisfied with the steps taken by the police in respect of illegal slaughtering of the animals as well as illegal sale of meat in the areas within the jurisdiction of the said Deputy Commissioners of Police. Undercurrent of the said Shivgan affidavits seems to be that there is deterrence on the part of the police authorities to take action in respect of the aforesaid in the areas within their jurisdiction. It is significant to note that except in two cases, cognizance of the complaints have been taken only under section 410 of Municipal Corporation of Greater Mumbai Act, 1888. We fail to understand as to why in respect of the other cases, action under the IPC is not being taken as also the Maharashtra Animal Preservation Act, 1976. What we find is that the buck is sought to be passed by the Police to the Municipal Corporation of Greater Mumbai and vice versa. We, therefore, direct the two Deputy Commissioners of Police to come up with an action plan in respect of what they propose to do as regards the complaints of the petitioners. Such directions have already been issued by the order dated 6.3.2017 passed in the above writ petition. We, therefore, direct the two Deputy Commissioners of Police to file their personal affidavits. To facilitate the same, hearing of the above petition is deferred to 8.9.2017. Parties to act upon a copy of this order duly authenticated by the Sheristedar of this Court.
