ORDER : The petitioner was appointed as a weighman on 19.05.1973. However in view of his educational qualification, in terms of the extant Rules he was conferred the status of the Senior Weighman vide order dated 18.04.1974 effective 01.04.1974. The post of weighman was thereafter abolished but the petitioner was absorbed as Senior Packer effective 23.11.1990. He was then given benefits of second selection pay scale at the completion of 18 years of service vide order dated 08.10.1992. The case of the petitioner now is in the petition, filed in the year 2015 is that he was entitled to the benefit of the first selection scale on completion of 9 years of service in 1983 which was allegedly wrongly denied to him. Heard. Considered. This Court is increasingly burden with stale matters without regard to the doctrine of laches. The instant case is an outstanding example of such reckless filing of petition. If all the petitioners was aggrieved of non grant of first selection scale on the completion of 9 years of service following his appointment in 1973. He ought to have approached this Court at the relevant time sometime in 1983. More particularly on or soon after 08.10.1992 in any event he was granted benefit of the second selection scale. The petitioner’s in the first instance explanation that all along he was representing to the respondent for the last about over 20 years, is no avail. It is settled that repeated representations do not postpone the cause of action for availing remedy in law. The petition is clearly hit by laches. No plausible ground has been proffered to the satisfaction of this Court for the inordinate delay in filing the writ petition. The petition is therefore dismissed.
