JUDGMENT ORDER Pardeep Nandrajog, C.J. - Heard learned counsel for the parties. 2. Convicted for the offences punishable under Section 279 and 338 IPC, the petitioner has been sentenced to undergo simple imprisonment for three months for each offence and pay fine in sum of 200/- convicted for the offence punishable under Section 337 IPC, the petitioner has been sentenced to undergo simple imprisonment for one month and pay fine in sum of Rs. 100/-. 3. The petitioner was the driver of a Jonga. It is alleged against him that due to he driving the Jonga rashly and negligently he caused the accident in which the passenger traveling in the bus was injured. The injury on the passenger name Jetha Ram is on the right elbow. 4. The evidence shows no collusion between Jonga and the Bus. It is an apparent that the two vehicles, traveling in opposite direction crossed each other at a very proximate distance. Jetha Ram who was sitting on the window seat of the bus had rested his elbow on the window. It was protruding out. Jetha Ram has attributed to the injury suffered by him. 5. There is an element of rashness on behalf of the petitioner as well, which is evidenced from the site plan (Exhibit P-3). The same shows that he drove the Jonga using more space on the road which otherwise he should have used while driving the Jonga. 6. This is critical aspect of the evidence has been overlooked by both the Courts below. Offences punishable under Section 279, 337 and 338 IPC are punishable with a fine. 7. I dispose of the petition maintaining the conviction but set aside the sentence imposed upon the petitioner and simultaneously enhancing the fine. For the offence punishable under Section 279 IPC the petitioner shall pay a fine of Rs. 3000/-. For the offence punishable under Section 337 IPC the petitioner shall pay fine of Rs. 1000/-. For the offence punishable under Section 338 IPC the petitioner shall pay a fine of Rs. 3000/-
