ORDER : Heard the parties. 2. In the instant writ petition, the petitioner has prayed for payment of the arrears of salary since his joining i.e. 06.02.2006. 3. Mr. Mahesh Kumar Sah, learned counsel appears on behalf of the petitioner and argues that from the date of his joining i.e. 06.02.2006, he is discharging his duties as per the satisfaction of the respondents-authorities. It has also been argued that the State of Jharkhand has released honorarium payment as fixed by the Jharkhand Education Project for the proposed primary school and the amount is being deposited in the account which is being operated jointly by the President and Secretary of the said Village Education Committee. The petitioner has filed several representations before the respondents-authorities regarding payment of the honorarium, as fixed by the Village Education Committee. That on his representation, the matter was recommended by the Block Education Extension Officer, Kathikund on 12.02.2007 and was asked to pay the honorarium immediately. Again on 11.07.2008, the District Superintendent of Education-cum-District Programme Officer, Dumka also affirmed the same and recommended his case for further action. 4. Learned counsel submits that in view of the recommendations of the District Education Officer and also of the Block Education Extension Officer, Kathikund, the payment ought to have been made, but till date the petitioner has been deprived of the same. 5. On the other hand, counter-affidavit has been filed by the respondents. Learned counsel for the respondents-State submits that if the petitioner has been appointed as per the norms of the Selection Committee, the respondents are bound to make the payment for the period which he has worked. 6. In view of the rival submissions of the parties, this Court is satisfied that the petitioner has been deprived of his legitimate claim and as such, the respondent-authorities are directed to pay the honorarium to this petitioner, which is due from 06.02.2006, within a period of two months from the date of receipt of a copy of this order, as he is still working. 7. With the aforesaid observation, the writ petition is allowed.
