ORDER : PRADEEP NANDRAJOG, J. 1. Of the three accused, petitioner-Kania is dead. Thus, qua him the proceedings abate. Pertaining to Kaliya and Nawab Khan, convicted for the offences punishable under Sections 457 and 380 IPC, both of them have been sentenced to undergo R.I. for a period of two years for each offence. The sentences have to run concurrently. Nawab Khan has also been convicted for the offence punishable under Section 3/25 of the Arms Act for which sentence imposed is one year R.I. This sentence has also to run concurrently. 2. Kaliya has undergone a sentence of one year. Nawab Khan has undergone a sentence of 287 days. 3. The theft to place on 19.04.1996. 21 years have gone by. 4. Learned counsel for the petitioners prayed for leniency. 5. In my opinion no useful purpose shall be served to send the petitioners to suffer the remaining sentence thus, I dispose of the petitions filed by the Kaliya and Nawab Khan directing that the offences committed by them, they shall suffer the sentence already undergone.
