ORAL ORDER : M.R. SHAH, J. RULE. Shri. Bipin Mehta, learned advocate waives service of notice of rule on behalf of the private respondents and Shri. Rohan Yagnik, learned Assistant Government Pleader, waives service of notice of rule on behalf of the respondent-State Authorities. 2. Having heard learned advocates for the respective parties and considering the fact that the main Letters Patent Appeal is admitted today and the ad-interim relief granted earlier has been continued till date, it is directed that, the ad-interim relief granted earlier be continued as interim relief during the pendency and final disposal of the main Letters Patent Appeal. 3. Having heard the learned advocates for the respective parties on interim relief, and considering the fact that in similar set of facts and circumstances with respect to another Municipality in Civil Application No. 12349 of 2016 in Letters Patent Appeal No. 1347 of 2016, the Division Bench of this Court has granted the stay of further implementation and operation of the similar order passed by the learned Single Judge, it is directed that, by way of interim relief, during the pendency and final disposal of the main Letters Patent Appeal, there shall be stay of further implementation and operation of the impugned judgment and order passed by the learned Single Judge. Rule is made absolute accordingly. No costs.
