ORAL ORDER : SONIA GOKANI, J. Rule. Learned APP waives service of rule for the respondents. 2. For getting temporary bail for a period of 30 days on the account of departure of maternal grandmother of the applicant for heavenly abode, this application is made. 3. This Court, having heard both the sides, notices that he had been enlarged on temporary bail from 19.10.2017 to 28.10.2017 for treating himself and had reported well in time, without any untoward incident. 4. Presently, it is visible from the details provided by the jail authority that the period undergone by him is only of one year and one month for the offence punishable under Section 307 of the Indian Penal Code and Sections 2(2)(5), (3)(1) of the Scheduled Castes and the Scheduled Tribes (Prevention) of Atrocities Act. 5. Considering the genuine cause the applicant is permitted temporary bail for a period of FIVE DAYS only, i.e. from 8th December, 2017 to 12th December, 2017, on his furnishing personal bond in the sum of Rs. 10,000/- and one solvent surety of the like amount and on conditions that: (1) he shall not leave India without the prior permission of this Court; (2) he shall not indulge in any activity contrary to law; (3) he shall surrender before the concerned jail authority immediately on expiry of the aforesaid period; 6. Rule is made absolute, accordingly. Office to send a copy of this order to the concerned jail authority through Fax, forthwith. Direct service is also permitted, TODAY.
