ORDER : ANANT S. DAVE, J. 1. Heard learned advocate for the applicant and learned Additional Public Prosecutor. 2. In view of the application for suspension of sentence and grant of regular bail by the applicant-convict through jail, by an order dated 29.11.2017, we have requested the learned advocate from the penal of advocates of Gujarat High Court Legal Services Committee and Mr. Hardik K. Raval has appeared on behalf of the applicant-convict. While taking us the detailed evidence containing paper book, it is submitted that the case on hand is based on different version of burn victim, who, later on died, and what is declared before the Medical Officer at Hospital Shankhalpur and in her dying declaration discrepancy appear on record. Besides this, the applicant herein also received burn injuries that the case of the prosecution is believe to have been proved beyond reasonable doubt by the trial Court considering the period of imprisonment of the convict so far about 6 years period of imprisonment, the case may be considered as prayed for. 3. Learned APP has opposed the grant of bail. 4. Considering the facts and circumstances, we are inclined to fix the Criminal Appeal No. 1124 of 2015 as early as possible preferably in 3rd week of March, 2018. 5. In view of the above, the present application stands disposed of accordingly.
