ORDER : S.H. VORA, J. 1. By way of present applications, applicant-State of Gujarat has prayed to fix up the matters for hearing and/or to vacate the stay granted by this Hon'ble Court (Coram: Hon'ble Ms. Justice Harsha Devani) vide order dated 27.11.2013 in Special Criminal Application No. 3348 of 2013 and allied matters. 2. Vide order dated 27.11.2013, the court passed following order: “Heard Mr. Premal Nanavaty, learned advocate with Mr. B.S. Khatana, learned advocate for the petitioner. Issue Notice returnable on 9th December, 2013. By way of ad-interim relief, further proceedings pursuant to the first information report in question are hereby stayed qua the petitioner herein. Direct Service is permitted qua the second respondent. Registry to place a copy of this order in each of the matters.” 3. Learned APP for the State of Gujarat makes submission at bar that because of the stay operating on further proceeding pursuant to the FIR being I-C.R. No. 10 of 2006 registered with Gandhinagar Zone Police Station (CID Crime), the investigation could not be carried out and therefore, made a request to fix the hearing of the main matters or to vacate the stay granted in favour of the original petitioners. Looking to the nature of accusation made in the FIR, no prejudice or harm will cause to any of the parties if State is permitted to investigate in the offence alleged against the petitioners and therefore, order granted on 27.11.2013 requires modification to the extent that the State may proceed with the investigation pursuant to the FIR in question, but it shall not take any co-service steps against the original petitioners-opponents herein. 4. In view of above observation and direction, present applications stand disposed of.
