JUDGMENT : Heard learned counsel for the petitioners and learned counsel for the respondents. 2. The petitioners are the Assistant Teachers working in the District of West Singhbhum since 1994. They were granted Grade-1 and 2 scale by the competent authority. The petitioners claim that they have completed more than 8 years in Grade - 1 and have now become eligible for grant of Grade- 4 pay scale. 3. It has been submitted on behalf of the petitioners that in spite of their eligibility, they have not been considered by the concerned respondent and they have not been placed in Grade-4 scale. Lastly, it has been submitted that there are more than 131 vacancies still existing. 4. Learned counsel appearing on behalf of the State submits that now a fresh seniority list is under preparation and if the petitioners falls within the zone of consideration and if any vacancy exits, their cases will definitely be considered and appropriate order shall be passed. 5. Having regard to the submissions made by the parties, I direct the petitioners to file fresh representations before respondent No. 3-District Superintendent of Education-cum- Secretary, District Education Establishment Committee, West Singhbhum at Chaibasa within a period of eight weeks from today. On receipt of such representation, the said respondent No. 3 shall consider the cases of the petitioners strictly in terms of the seniority list, which is under preparation and after taking into consideration the vacancy position, he will pass an appropriate order for placing the matter before the District Establishment Committee for an appropriate decision in the matter. If the Committee decided the issue in favour of the petitioners, necessary consequential orders should be passed. 6. It is expected that the entire process should be completed within a period of 16 weeks from the date of filing of the representation. 7. With this observation and direction, this writ application stands disposed of.
