ORDER : Pradeep Nandrajog, J. Filed in public interest grievance is to the encroachments on land comprised in Khasra No. 279, 306, 307, 334 & 354 in village Tausar. Jamabandi annexed as Annexure-1 to the writ petition shows that land is 'Gair Mumkin Gochar' land i.e. grazing land for the benefits of all villagers. 2. Various representations made to the Collector have been annexed with the writ petition and the grievance is that the Collector is not looking into the representations. Photographs filed along with the writ petition show permanent constructions being made. 3. Whether photographs pertain to the site are not has to be determined by the competent authority. Suffice to it state that it is the duty of the Collector to ensure that no encroachments are made on Gochar land. 4. We dispose of the writ petition directing District Collector, Nagaur to treat the instant writ petition as a representation and the present order as a direction to him. The direction would be to call for a report from the tehsildar pertaining to the subject lands. If there are encroachments, action as per law would be taken against the encroachers and it shall be ensured that the land is used for the purpose as per the revenue records. 5. The petitioner shall obtain a copy of the present order and along the writ petition and its annexures serve the same in the office of respondent No.2, who shall take necessary action within three months from the receipt of the order. 6. No costs.
