JUDGMENT Mr. Jitendra Chauhan. J. (Oral):- The present petition has been filed under Section 439 the Cr.P.C seeking bail in case FIR No. 169 dated 03.07.2015 registered under Section 302, 323 and 148 read with Section 149 IPC at Police Station Sadar Ferozepur, District Ferozepur. 2. At the outset, learned counsel for the petitioners states that he has instructions to withdraw the present bail application filed on behalf of petitioner Nos. 2 & 3, namely Jangir Singh and Gurdev Singh. 3. Dismissed as withdrawn qua petitioner Nos. 2 & 3. 4. As regards, petitioner No.1, Kuldeep Kaur @ Kaura Bai, it is contended that she was declared innocent by the police. It is further contended that no injury has been attributed to her. Similarly, situated co-accused Binder Singh, Piara Singh and Chanan Singh have already been admitted to bail by this Court. 5. On the other hand, the learned State counsel opposes the bail application. 6. Heard. 7. Considering the fact that the petitioner was declared innocent at one point of time; no injury has been attributed to her; out of 14 prosecution witnesses, none has been examined so far, therefore, it can be safely inferred that the completion of trial will take a long time so, without commenting on the merits of the case, this petition is allowed. The petitioner No.1 (Kuldeep Kaur @ Kaura Bai) be admitted to bail during the pendency of trial, on her furnishing bail bonds and surety bonds to the satisfaction of trial Court/duty Magistrate concerned. 8. Anything said herein above shall not be construed as an expression of opinion on the merits of the case.
