JUDGMENT : GURMIT RAM, J. 1. This petition has been filed for the grant of interim bail to the petitioner – Jagir Singh for 15 days to attend the marriage of his daughter which is stated to be fixed for 29.1.2017. The petitioner is stated to be implicated falsely in case FIR No.128 dated 1.11.2016, under Section 302 read with Section 34 of the IPC, registered at Police Station Sadar, Nawan Shahar, District Shaheed Bhagat Singh Nagar and he is presently lodged in Central Jail, Ludhiana. 2. Learned State counsel on instructions from ASI Purshotam Lal, Police Station Sadar, Nawan Shahar, District Shaheed Bhagat Singh Nagar has stated that on verification by the concerned police, it is found that marriage of Mandeep Kaur, daughter of the present petitioner, is fixed for 29.1.2017 with Sumandeep Singh Bola son of S. Pakhar Singh Bola, resident of V.P.O. Urapar (S.B.S. Nagar). The marriage is to be solemnized at Channi Resorts, Rahon to Phillaur Road, Rahon, Shaheed Bhagat Singh Nagar as per the detail mentioned in the marriage card. Learned State counsel further submits that the son of the petitioner has also been implicated in this case and presently he is also lodged in Central Jail, Ludhiana. It is also submitted that no other case is pending against the petitioner except the case in hand. 3. Since the marriage of the daughter of the petitioner is fixed for 29.1.2017, his presence is essential to perform the rituals on the occasion of marriage of his daughter. So in the interest of justice, this petition is allowed. The petitioner – Jagir Singh is granted the benefit of 15 days interim bail in order to enable him to attend the marriage of his daughter which is to be performed on 29.1.2017, subject to his furnishing bail bonds and surety bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Shaheed Bhagat Singh Nagar. This period of 15 days will commence from the date, when he (petitioner – Jagir Singh) furnishes bail bonds and surety bonds and the same are accepted by the above-said Court of learned Chief Judicial Magistrate/Duty Magistrate, Shaheed Bhagat Singh Nagar. It is further directed to the said Court to inform him (petitioner – Jagir Singh) about the date on which he has to surrender in jail, after the expiry of said period of 15 days. 4. The present petition is disposed of accordingly.
