ORDER : Pankaj Bhandari, J. Petitioners have filed this miscellaneous bail application under Section 438 Cr.P.C., 1973 2. F.I.R. No. 58/2006 was registered at Police Station Shambupura, District Chittorgarh for offence under Sections 302, 201 of I.P.C. 3. It is contended by counsel for the petitioners that the matter pertains to the years, 2006. Police has submitted a negative final report on 17.01.2008. Thereafter, after recording of the statements of the complainant, the Court have taken cognizance on 28.01.2015 and summoned the petitioners through non-bailable warrant. 4. Learned Public Prosecutor has opposed the bail application. 5. I have considered the contentions. 6. Considering the contentions of counsel for the petitioners as also the fact that initially Police submitted a negative final report and after a lapse of nine years, petitioners have been summoned through non-bailable warrant, I deem it proper to allow the anticipatory bail applications of the petitioners. 7. The anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Shambhupura, District Chittorgarh in F.I.R. No. 58/2006 is directed that in the event of arrest of the petitioners they shall be released on bail, provided they furnish a personal bond in the sum of Rs. 50,000/- with two sureties in the sum of Rs. 25,000/- each to their satisfaction on the following conditions :- (i). that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii). that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii). that the petitioners shall not leave India without previous permission of the court.
