JUDGMENT 1. - This bail application has been preferred on behalf of the accused-petitioner under section 438 Cr.PC apprehending his arrest in FIR No.103/2016 police Station Parsad, Udaipur registered for the offences punishable under sections 379, 380 & 411 IPC. 2. Heard learned counsels for the petitioner as also learned Public Prosecutor. 3. Learned counsel for the petitioner submits that the petitioner is the owner of the building of Parasmani Hotel. He has given the premise on rent to Rajveer. Rajveer and Sushil Kumar are running the hotel. There is no role of the petitioner in any business of theft being committed by them of the chemical alleged to be stolen from the tanker. He was neither present on the scene of occurrence. 4. Learned Public Prosecutor has vehemently opposed the prayer stating that the present petitioner is also actively involved in committing theft of the chemicals. 5. I have perused the investigation report and also the case diary. 6. Without expressing any opinion on the merits of the case and taking facts and circumstances of the case into consideration, this court deems it a fit case to grant anticipatory bail to the accused petitioner. Accordingly, the anticipatory bail application filed by accused-petitioner is allowed. It is ordered that in case of arrest of the accused-petitioner Laxman Lal S/o Shri Gokla Ji in F.I.R. No.103/2016 Police Station Parsad, District Udaipur, if the accused-petitioner furnishes a personal bond of Rs.40,000/- with two surety bonds of Rs.20000/- each to the satisfaction of the investigating officer then he shall be immediately released on bail with the following stipulations:- (i) That the petitioner shall make himself available for interrogation by a police officer as and when required. (ii) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and (iii) That the petitioner shall not leave India without previous permission of the court. Bail application allowed. *******
