TARACHAND v. BARODA RAJASTHAN GRAMIN BANK

SANDEEP MEHTA

body2017
JUDGMENT : Sandeep Mehta, J. The respondents have taken a specific objection in their reply that the petitioner has available to him the statutory remedy of appeal against the impugned order and that the writ petition is not maintainable. 2. Learned counsel for the petitioner is not in a position to dispute the above fact. He candidly concedes that the writ jurisdiction of this Court cannot be invoked in view of the Supreme Court Judgment in the case of United Bank of India v. Satyawati Tondon & Ors., reported in AIR 2010 SC 3413 . 3. Accordingly, the instant writ petition is dismissed on the ground that the petitioner has available to him a statutory remedy of filing an appeal against the impugned order. 4. Stay application is also dismissed.
