ORDER : NIRMALJIT KAUR, J. 1. After arguing for some time, learned counsel for the petitioner submitted that he may be allowed to withdraw the present writ petition as not pressed but prayed that reasonable time granted to the petitioner for vacating the suit premises. 2. In view of the above, the petition is dismissed as not pressed. However, the petitioner shall not be evicted from the suit premises on or before 30.04.2018 and he shall be allowed to retain the possession of the same uptil the said date and shall handover its vacant possession of the suit premises to the respondent-landlord on or before 30.04.2018 subject to an undertaking to be furnished by the petitioner before the Rent Tribunal, Jodhpur to the said effect within 10 days from today i.e. on or before 13.11.2017 The petitioner shall continue to pay the mesne profit regularly as already awarded by the tribunal till the vacation of the disputed premises i.e. on or before 30.04.2018 However, the arrears of rent, if not already paid, shall also be deposited within one month from today i.e. on or before 01.12.2017 3. In case, the said undertaking is not furnished within the stipulated period or any of the conditions are violated, the respondent-landlord shall be free to proceed for executing the decree in question. The respondent-landlord will have liberty to proceed further for the contempt of Court in case, the petitioner do not vacate the premises on or before 30.04.2018.
