JUDGMENT Mr. Jitendra Chauhan J. (Oral):- The present petition has been filed under Section 439 Cr.P.C seeking bail in case FIR No. 195 dated 08.03.2016 registered under Sections 409, 420, 467, 468, 471 and 120-B IPC at Police Station Civil Lines, Karnal, District Karnal. 2. Learned counsel for the petitioner contends that the the petitioner has been falsely implicated in the present FIR. The petitioner did not prepare any forged vouchers as alleged in the FIR. The petitioner was, in fact, in need of funds and had approached co-accused Sukhwinder Singh who through RTGS credited Rs.1 lakh in the account of the petitioner. The same amount was allegedly recovered during the raid by the police from his house which was withdrawn by him to meet the family requirements. He further states that co-accused Amrendra Kumar Srivastva from whom Rs.8,91,867/- has been recovered has been admitted to bail. Learned counsel further states that the petitioner has a better case as compared to co-accused Amrendra 3. The order Annexure P-5 has not been assailed by the State. Learned State counsel fairly states that the case of the petitioner is at par with co-accused Amrendra Kumar Srivastva. 4. Heard. 5. The Court is conscious of the fact that this is the second bail petition. However, considering the fact that the petitioner is in custody since 17.06.2016; co-accused Amrendra Kumar Srivastva has already been released on bail; out of 29 prosecution witnesses, only examination-in-chief of the complainant so far has been recorded. All the PWs are official witnesses, therefore, it can be safely inferred that the completion of trial will take a long time so, without commenting on the merits of the case, this petition is allowed. The petitioner be admitted to bail during the pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/duty Magistrate concerned. 6.
