ORDER : ALOK SHARMA, J. 1. Heard the counsel for the petitioner and perused the impugned order dated 02.12.2015 whereby the petitioner-plaintiff's application under Order 6 Rule 17 CPC has been dismissed. 2. For one this petition challenging the order dated 02.12.2015 has been filed on 02.06.2017 after a delay of after a year and a half without any plausible reason. The petition is therefore liable to be dismissed on this count alone. 3. Aside of the aforesaid the amendment was sought by an application on 19.02.2015 based on a purported ground of a event subsequent, of 22.12.2012 The trial court in the circumstances noted that the amendment for whatever its worth was belatedly sought and further that the application was not supported by any affidavit. The court has also found that there was no material on record in support of the allegation in the application that petitioner-plaintiff was in possession of the disputed land at the time of filing of the suit and had during the pendency of the suit been forcibly dispossessed. 4. I am of the considered view that good reasons have been set out by the trial court in dismissing the application under Order 6 Rule 17 CPC. The impugned order does not suffer from any capriciousness or unjustness nor for that matters is vitiated for any illegality. 5. I find no force in the petition, Dismissed.
