ORDER : 1. In pursuance of the directions in this petition, Mr. S.K Vyas, AAG along with Mr. Achal Singh, Investigating Officer produced the corpus Ms. Payal Singhvi before us. 2. We have ascertained from the corpus Payal Singhvi whether she is under any threat or inducement by any one, she refused and said that she is present in the Court as per her will. 3. Learned Senior Advocate Mr. M.R Singhvi and Mr. N.K Bohra, counsel for the petitioner vehemently argued that without any procedure for converting religion nobody can convert his or her religion and as per the judgment of Constitutional Bench of the Hon'ble Supreme Court in the case of Rev. Stainislaus v. State of Madhya Pradesh [ (1977) 1 SCC 677 : AIR 1977 SC 908 ], the rules for conversion of religion can be framed by the Sate Government. It is also submitted that all the documents filed before the Police to prove the conversion of religion by Payal Singhvi are doubtful and self contradictory, therefore, cannot be establish the fact of marriage. 4. It is also submitted that although Payal Singhvi is belonging to Hindu community and Faiez Modi belongs to Muslim community and under the threat the so-called Nikah is solemnized and conversion of religion is also doubtful because no conversion can be made only on the basis of affidavit, therefore, it is very serious question which is decided in this matter. 5. After hearing the learned counsel for the petitioner and perusing all the documents produced before us to prove the fact of ‘Nikah’, we are of the opinion that very important question “whether without any procedure or rule conversion of religion can be changed or not so also in this case whether the fact of ‘Nikah’ of Payal Singhvi is established on the basis of self contradictory documents on record or not” is in question. 6. In view of above, to decide the aforesaid question, the Additional Advocate General is directed to file reply within a period of four days. 7.

After perusing the documents submitted before us prima facie we are of the opinion that the investigation is required to be made for ascertaining the truthfulness of the documents, therefore, after ascertaining willingness of the corpus Payal Singhvi, we deem it appropriate to lodge the corpus Payal Singhvi at the Nari Niketan Jodhpur for a period of one week and to produce her before us on 07.11.2017 The State Government is directed to provide all facilities to the corpus Payal Singhvi in the Nari Niketan Jodhpur and no person either of the party shall be allowed to meet her. The SHO Mr. Achal Singh, Police Station Pratap Nagar present in person is directed to provide adequate security to the family members of Faiez Modi as also the family member of the petitioner. 8.
