ORDER : 1. The prayer sought for in the writ petition is for issuance of a Writ of Mandamus, to direct the 2nd respondent to instruct the 3rd respondent to receive the recurring deposit amount remitted by the petitioner in pursuance of the orders passed by the 1st respondent in proceedings No.20163/09/K14, dated 21.07.2009 and by considering the petitioner's representation, dated 07.09.2009. 2. Heard Mr. Karthik Raja, learned Counsel appearing for the petitioner, Mr. G. Muthukannan, learned Government Advocate, appearing for the first respondent and Mr. R. Murugappan, learned counsel appearing for the second and third respondents and perused the materials available on record. 3. The learned counsel appearing for the petitioner would submit that the petitioner's representations, dated 31.08.2009 and 07.09.2009 respectively were not considered by the respondents. Hence the present Writ petition. 4. He further submitted that if a direction is issued to the respondents to consider the representations of the petition, the petitioner would be satisfied. 5. The learned counsel appearing for the respondents would submit that the petitioner may be directed to give a copy of the representation submitted in the year 2009 and also give a fresh representation to the second respondent for consideration. 6. In view of the above submissions, without going into the merits of the case, this Court directs the petitioner to give a fresh representation along with the copy of earlier representation within a period of two weeks from the date of receipt of a copy of this order. On such compliance, the second respondent shall consider the same and pass orders on merits and in accordance with law, after providing opportunities to necessary parties within a period of eight weeks therefrom. 7. With the above directions, this Writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
