JUDGMENT Mr. Jitendra Chauhan. J. (Oral):- The present petition has been filed under Section 439 Cr.P.C seeking bail in case FIR No. 127 dated 21.08.2017 registered under Sections 363 and 366 IPC at Police Station City Batala, Police District Batala, District Gurdaspur. 2. Prosecutrix with her father Sudesh Kumar heard in person. 3. It is contended that the petitioner and the prosecutrix daughter of the complainant had solemnized marriage on 19.08.2017. By way of CRM M-31004 of 2017 the petitioner along with prosecutrix approached this Court for protection of life. However, the said petition was dismissed as withdrawn. 4. At this stage, the learned counsel for the complainant, on instructions states that the marriage solemnized between the petitioner and the prosecutrix has now been approved by the respective families and the prosecutrix has been residing at the matrimonial home. 5. On the other hand, the learned State counsel, on instructions, states that the prosecutrix has not yet attained majority. 6. Heard. 7. Considering the fact that the prosecutrix has been residing at the matrimonial home; her present age is approximately 17 years and 7 months, therefore, this Court feels that the prosecutrix has reached the age of discretion so, without commenting on the merits of the case, this petition is allowed. The petitioner be admitted to bail during the pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/duty Magistrate concerned. 8. Anything said herein above shall not be construed as an expression of opinion on the merits of the case.
