ORDER : PRADEEP NANDRAJOG, J. Heard learned counsel for the appellant. 2. We find no infirmity in the equitable view taken by the learned Single Judge. 3. The respondents had to fill up the applications and make payment on-line. On line applications submitted by them were in order evinced by the fact that ID Nos. 1401001801526591 and 1401001801533858 were generated and information was received on the mobile phones of the respondents. Simultaneously on the web screen transaction IDs were shown. Using ATM-cum-Debit Card the respondents paid the fee on line. The banker i.e. SBBJ sent the message on the SMS that their account had been debited. Due to glitch in the operating system of the appellant the money was not credited to the account of RPSC and thus the application IDs were not generated. 4. It is obviously a case where the software programme of the appellant had a temporary failure and for which the respondents cannot be blamed. 5. It is also relevant to note that the respondents approached the Court promptly when admit cards were not issued to them. Under interim orders the appellant was directed to issue the admit cards. The respondents took the examination and thus the learned Single Judge has rightly held that qua the respondents the merit position would be determined in the category in which they have applied and if they are found having attained marks entitling them to be offered appointments, subject to other formalities to be completed, appointment orders would be issued. 6. The appeal is dismissed.
