ORDER : PRADEEP NANDRAJOG, J. 1. Special Leave to Appeal Writ No. 3198/2017: Allowed. Leave to appeal is granted. Special Appeal (Writ) No.669/2017: 1. Grievance of the appellant is to the order dated 16.05.2017 passed by the learned Single Judge disposing of S.B. Civil Writ Petition No.5932/2013 filed by Smt. Khetu. 2. Case of Smt. Khetu was that she was applicant before the Municipal Board, Nokha for regularisation of shop No.25, Bus Stand Nokha and that the Municipal Board was not properly considering her case for regularisation of the shop. The direction issued by the learned Single Judge is that she should appear before the Executive Officer of the Municipal Board, Nokha and provided she deposits the requisite amount for regularisation, necessary orders would be passed. 3. In appeal the appellant states that he is the brother of Smt. Khetu and that his father, who would be obviously the father of Khetu, had been depositing the money although the application was in the name of Smt. Khetu. The appellant claims to be in possession of the shop. 4. Suffice it to state the case of the appellant therefore would be that his sister was a 'Benamidar'. It is settled law that a writ court would not declare a title by going into disputed question of fact. 5. Whether or not appellant's sister was a 'benamidar' is a question of fact and has to be adjudicated post trial. The applicability of the Benami Transactions (Prohibition) Act, 1988 would also arise for consideration. Since Smt. Khetu was concededly the applicant before the Municipal Board, Nokha, the impugned direction cannot be interdicted in appeal. The appellant claims to be the beneficial owner and his sister to be the 'benamidar' for which the appellant has to file a civil suit. 6. The appeal is dismissed.
