JUDGMENT Mr. Inderjit Singh, J.:- Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.05 dated 11.01.2015 under Sections 307, 353, 186, 148, 149 IPC and Sections 25 and 27 of the Arms Act, registered at Police Station Cantt. Bathinda. 2. Notice of motion was issued. Learned State counsel appeared and contested the petition. 3. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. 4. As per the case of the petitioner, he absented during the trial on 11.05.2017. The petitioner has already surrendered before the Court and has been released on interim bail. Learned counsel for the petitioner states that the absence of the petitioner is not intentional and he could not attend the Court due to mis-communication of date by his counsel. 5. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. 6. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 20.06.2017 granting interim bail to the petitioner, is made absolute.
