ORDER : Pankaj Bhandari, J. Petitioner has filed this bail application under section 439 of Cr.P.C., 1973 2. F.I.R. No.173/2017 was registered at Police Station Clock Tower, Ajmer for offence under Sections 342/363/366/366A/376/376(2)(N) I.P.C. read with Sections 3/4/5(L)/6 of POCSO Act 2012. 3. It is contended by the counsel for the petitioner that as per the medical evidence the prosecutrix who is between 18 to 20 years of age has solemnized marriage with the petitioner on 13.7.2017 at Arya Samaj, Ajmer. It is contended that in the initial FIR there was allegation was that the prosecutrix went away with the petitioner and took Rs. 65,000/- from her house. It is also contended that the prosecutrix went with the petitioner on her own free will and solemnized marriage with the petitioner. 4. Learned Public Prosecutor has opposed the bail application. 5. Considering the contentions put-forth by the counsel for the petitioner, I deem it proper to allow the bail application. 6. This bail application is accordingly allowed and it is ordered that the accused-petitioner shall be released on bail provided he furnishes a personal bond of Rs. 50,000/- (Rupees Fifty thousand only) and two sureties in the sum of Rs. 25,000/- (Rupees Twenty Five thousand only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court and any court to which the matter is transferred, on all dates of hearing and as and when called upon to do so.
