ORDER : This Writ petition is filed to direct the respondent to grant permission and to provide police protection to the petitioner to conduct the 100th year Festival of Ex-Chief Minister Thiru.M.G. Ramachandran on 14.08.2017 at SPR Plots, Alagarkoil Road, Near Aatrukkal Pillaiyar Koil, Melur, Madurai District, on the basis of the petitioner's representation dated 07.08.2017. 2. Heard Mr.S. Meenakshisundaram, learned Senior Counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondent. 3. The learned Senior counsel appearing for the petitioner states that the petitioner is the Town Secretary of Melur AIADMK (AMMA ANI) and that he is going to celebrate 100th year festival of Ex-Chief Minister Thiru.M.G. Ramachandran on 14.08.2017. He further submitted that on that day the petitioner and the organizers have proposed to offer welfare scheme to the general public. Since the place chosen by the petitioner belongs to an individual by name S.P. Ramachandran and the petitioner has also paid rent to the said person, the learned Senior counsel for the petitioner states that there would not be any problem for conducting the programme in the place earmarked by the petitioner. Though the petitioner has appeared before the respondent Police in person on 07.08.2017 and gave a representation to grant permission and provide protection to the petitioner for conducting the function scheduled to be held on 14.08.2017, the respondent Police has not passed any orders so far and that therefore, the petitioner states that he has approached this Court for the relief prayed for in the Writ Petition. 4. The learned Special Government Pleader appearing for respondents has serious objection with regard to the place in which the programme is organised. According to him, the area earmarked by the petitioner will cause hindrance to the public. Since the learned Senior counsel appearing for the petitioner submitted that the place earmarked is sufficiently bigger in size and it is not likely to cause any hindrance to the public or traffic. The petitioner has also agreed that the respondent can put any reasonable restrictions for parking vehicles and conducting procession. In such a view of the matter, this Court is also of the view that the petitioner can be permitted to conduct the programme without hindrance to the public. 5. Considering the fact that the petitioner is not organizing any protest against political party or any individual and the petitioner also undertakes that he is conducting the programme wholly at his own cost, this Court is inclined to pass the following order:- “The respondent is directed to consider the representation of the petitioner dated 07.08.2017 and grant permission to conduct 100th year festival of Ex-Chief Minister Thiru M.G.Ramachandran on 14.08.2017 SPR Plots, Alagarkoil Road, Near Aatrukkal Pillaiyar Koil, Melur, Madurai District, subject to any reasonable restrictions or conditions so as to maintain the law and order and communal harmony and any other special conditions that may preserve public interest subject to the condition that the petitioner or any other person engaged by him shall not speak or shout slogans against any other person of any other party provoking the party men which may likely to cause any disruption of peace or public order.” 6. With the above direction, the Writ Petition is disposed of. No costs. 7. The petitioner shall pay a cost of Rs.5,000/- (Rupees Five Thousand only) to the credit of the Hon'ble Chief Justice Relief Fund, Madurai Bench of Madras High Court, Madurai, by today before 4.30 p.m., failing which, the order copy shall not be furnished today.
