AMOL RATTAN SINGH

body2017
JUDGMENT : AMOL RATTAN SINGH, J. 1. By this petition, the petitioners seek the benefit of ad hoc service rendered by them, towards the grant of higher standard pay scales, upon their completing 10 years and 20 years of service, as also the benefit of additional increments on completion of 8 and 18 years of service, with the petitioners relying upon an order of a Division Bench of this Court dated 12.09.1994, in Manohar Lal and others vs. State of Haryana and others (CWP no. 749 of 1991), a copy of which has been annexed as Annexure P-5 with the petition. 2. Thereafter, the matter of counting of ad hoc service prior to regularization towards grant of higher standard pay scales went up to the Supreme Court, culminating in the judgment passed in State of Haryana and others vs. Haryana Veterinary and AHTS Association and another (2000) 8 SCC 4 , wherein benefit of ad hoc service for grant of higher standard pay scales was not accepted by the Supreme Court. 3. However, subsequently by a judgment of a Division Bench of this Court in Hanumant Singh and others vs. State of Haryana and others 2008 (4) SCT 427, counting of ad hoc service towards grant of additional increments on completion of 08/18 years of service was allowed. 4. Hence, in the present case, as regards the petitioners' claim for grant of higher standard pay scales after counting the ad hoc period of their services prior to regularization, that has to be rejected, nothing having been shown to this Court that the petitioners, even for their ad hoc period of services, were selected by a regular selection process as is carried out for making regular appointments. 5. As regards counting of ad hoc service towards grant of additional increments on completion of 08/18 years of service, the petition is allowed and the respondents are directed to count the said period of service for that benefit. 6. The benefits to be granted to the petitioners, after calculations, be released to them within a period of three months from the date of receipt of a certified copy of this order.
