ORDER : BANWARI LAL SHARMA, J. 1. This application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with C.R No. 61/2017, Police Station Desuri, District Pali, for the offences under Sections 420, 406, 504 and 120-B IPC. 2. Heard learned counsel for the petitioner and learned Public Prosecutor. 3. Learned counsel for the petitioner submits that complainant issued cheques to petitioner in connection to payment of some land transaction against the sale agreement which were returned unpaid by the banker of complainant for which after issuing notice under Section 138 N.I Act lodged compliant for offence punishable under Section 138 N.I Act against the complainant. 4. Therefore, as a counter blast complainant implicated petitioner in this falsely. Therefore, the petitioner may be extended the benefit of provisions of anticipatory bail. 5. I have considered the submissions made at bar. 6. On consideration of submissions made on behalf of the respective parties and the material made available for my perusal, therefore without expressing any final opinion on the merits and de-merits of the case and considering the overall facts and circumstances of the case, I am inclined to allow this bail application. 7. Accordingly, the bail application is allowed and it is directed that in the event of arrest of petitioner - Mohan Singh S/o Shri Laxman Singh in connection with C.R No. 61/2017, Police Station Desuri, District Pali, the petitioner shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- along with two sureties of Rs.25,000/- each to the satisfaction of the concerned Investigating Officer/S.H.O on the following conditions:— (i). that the petitioner/s shall make/s himself/themselves available for interrogation by a police officer as and when required; (ii). that the petitioner/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and (iii). that the petitioner/s shall not leave India without previous permission of the court.
