JUDGMENT ORDER Pankaj Bhandari, J. - Petitioner has filed this bail application under section 439 of Cr.P.C., 1973 2. F.I.R. No. 140/2017 was registered at Police Station Transport Nagar Distt. Jaipur for offence under Sections 8/20 read with Section 8/29 of NDPS Act. 3. It is contended by counsel for the petitioner that as per the prosecution story 2 Kg. of Ganja was recovered from conscious possession of the petitioner. Rest of the Ganja was recovered from the boot space. 4. It is contended that as many as 45 bags were recovered but the sample was not taken separately from each bag. 5. It is contended that if the recovery from the person of the present petitioner is only to be considered then the same is less than the commercial quantity. 6. It is also contended that petitioner has no criminal antecedents of like nature. 7. Learned Public Prosecutor has opposed the bail application. His contention is that 86 Kg. of Ganja has been recovered from the petitioner which is not less than the commercial quantity. 8. I have considered the contentions. 9. Considering the contentions put forth by counsel for the petitioner as also the view taken by Co-ordinate Bench of this Court in "S.B. Criminal Misc. IInd Bail No.6030/2017 (Ishwar Singh vs. State of Rajasthan)" wherein, also there was flaw in drawing samples this could be proper to enlarge the petitioner on bail. 10. This bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
