JUDGMENT/ORDER : VIJAY BISHNOI, J. This writ petition has been filed on behalf of the petitioner being aggrieved with the notice dated 9.11.2017 issued by the Panchayat Samiti, Raisinghnagar, District Sri. Ganganagar whereby, a demand of rupees ten lac has been raised against the Sarpanch of the Gram Panchayat Ganguwala, Panchayat Samiti Raisinghnagar, District Sri. Ganganagar. 2. Brief facts of the case are that under the M.L.A. Local Area Development Scheme, rupees ten lac were sanctioned for laying down a pipe line from 56 RB to 54 RB for the purpose of supplying drinking water to the villagers and the Gram Panchayat Ganguwala was appointed as Executive Agency for executing the work of laying down the said pipe line. 3. As per the Gram Panchayat, the work was completed as per specifications and the payment of the expenditure has also been made, however, later on, it was found that the pipe line for the purpose of supplying water to the villagers has not been laid as per the required specifications and there is a difference in the test value. Thereafter, the concerned officer has ordered for removal of the pipe line and for laying down new pipe line as per the required specifications and when the officials reached at the spot for removing the said pipe line, the Sarpanch of the Gram Panchayat has requested to re-test the newly laid pipe line with the claim that the same has been laid down as per the required specifications. 4. During the joint inspection, a report was prepared on 21.8.2017 wherein, it was agreed that the lab testing report be procured from the Central Institute of Plastic Engineering and Technology, Jaipur and thereafter the decision will be taken regarding removal of the pipe line. As per the report received from the Central Institute of Plastic Engineering and Technology, Jaipur, the pipe line was not laid down as per the required specifications and pursuant to that report, the Panchayat Samiti, Raisinghnagar has raised a demand of rupees ten lac from the Sarpanch as well as the Gram Sewak of Gram Panchayat Ganguwala. 5. After attempting to argue the matter for quite some time, learned counsel for the petitioner does not want to press this writ petition, however, seeks liberty for the petitioner to file an appropriate representation before the competent authority. 6.

Accordingly, this writ petition is dismissed as not pressed with the liberty to the petitioner to file appropriate representation before the competent authority in support of his claim that the pipe line in question was laid down as per the required specifications. If any such representation is filed by the petitioner, it is expected that the competent authority shall consider and decide the same objectively and expeditiously. 7. Stay petition is also dismissed.
