MAHESH GROVER, RAJ SHEKHAR ATTRI

body2017
JUDGMENT Mr. Mahesh Grover , J.: (Oral) - This is an appeal directed against the judgment of the learned Single Judge dated 23.4.2016 vide which the choice of the Collector in the matter of appointment of Lambardar of village Raipur, Tehsil Ballabgarh, District Faridabad was upheld. 2. Learned counsel for the appellant contends that the District Collector did not notice the merits of the appellant and gave one sided opinion. 3. We have perused the order of the Collector as well and do not find any such error. The merits of both the candidates as also their education have been faithfully recorded and in conclusion, he found respondent No.4 to be a better candidate. 4. On a closer examination, we find that both the candidates are almost equally educated and the Collector has exercised his choice in favour of respondent No.4 which we do not find any reason to interfere in the absence of any perversity. 5. It is a settled law that choice of the Collector in the matter of appointment of Lambardar has to be respected unless there is gross perversity in approach. We do not find any justifiable ground to interfere with the impugned order when it merely approves the choice of the Collector in the appointment of Lambardar. 6. Dismissed.
