ORDER : ALOK SHARMA, J. 1. Mr. S.K Gupta, AAG, counsel for the respondent states that reply to the petition has been filed today. And he pointed out that in SBCWP No. 15538/2016 filed by the petitioner-center after availing of the interim order passed on 08.12.2016 based on which students were admitted into the GNM course, the petition was withdrawn on 31.10.2017 Tag with SBCWP No. 15538/2016 to enable the court to evaluate the matter further and consequences of withdrawal of the petition. 2. The Registrar, RNC was directed to present in court. He appears, his presence is dispensed with till further orders. 3. The President, INC is also in the meantime directed to explain by way of an affidavit as to why under his oversight of INC the situation prevailed where the petitioner under SBCWP No. 15538/2016 having availed of the interim order dated 08.12.2016 and admitted students based thereon, the factum of inspection by INC on 15/16.05.2017 of the petitioner's center finding it not fulfilling prescribed parameters was not brought to the court's notice. And why liberty granted by the court in SBCWP No. 15538/2016 in such a situation to seek transfer of students provisionally admitted in the Academic year 2016-17 from the petitioner-center to another college recognized by INC was not availed. 4.
