ORDER : K.K. SASIDHARAN, J. The petitioner, earlier filed a writ petition in W.P.(MD).No.15855 of 2017, to direct the Hindu Religious and Charitable Endowments Department to conduct the temple festival of Arulmigu Umaiyanagiamman Temple situated at S.Tharaikudi Village, Kadaladi Taluk, Ramanathapuram District, after electing the new Board of Trustees. 2. This Court, taking into account the contention taken by the Hindu Religious and Charitable Endowments Department, directed the authorities to take early action for appointment of Board of Trustees. However, we have also pointed out that there is no need for the administration to wait for the appointment of new Board of Trustees for conducting the temple festival. We are informed that pursuant to the order passed by this Court to conduct the festival, the fourth respondent has printed pamphlets. The petitioner, therefore, is before this Court. 3. The learned Additional Government Pleader appearing for the respondents 1 to 3, 5 and 6, on instructions from the sixth respondent/Executive Officer, who is present in Court, submitted that the Executive Officer would conduct the festival, without the intervention of the fourth respondent. The said contention is recorded. 4. We have also heard Mr.M.Muniyasamy, learned counsel for the fourth respondent. 5. We make it clear that our earlier order dated 23.08.2017 in W.P(MD).No.15855 of 2017, would not give any right to the fourth respondent to conduct the temple festival misconstruing it as permission was granted to him to conduct the festival in the temple in question. It is a simple direction to conduct the temple festival. 6. Though the fourth respondent and other devotees are also entitled to participate as devotees, we make it clear that the only authority to conduct the festival is the Executive Officer. 7. The learned Additional Government Pleader submitted that there is a likelihood of law and order problem in connection with the temple festival and as such, direction should be given to the Superintendent of Police, Ramanathapuram District to provide necessary Police protection. 8. We direct the Superintendent Police, Ramanathapuram to provide necessary protection and assistance to the Executive Officer for the smooth conduct of the temple festival. 9. The Writ Petition is disposed of with the above direction. No costs.
