JUDGMENT : AMOL RATTAN SINGH, J. 1. This petition has been filed under Section 439 Cr.P.C., for grant of regular bail to the petitioner in case FIR No. 0322, dated 04.11.2016, registered for the alleged commission of offences punishable under Sections 13 (i) & 3 of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 and Section 11-D of the Prevention of Cruelty to Animals Act, 1960, registered at Police Station Ladwa, District Kurukshetra. 2. Learned counsel for the petitioner submits that the petitioner is identically placed with one Junaid, to whom this Court has already granted bail vide an order dated 30.01.2017 passed in CRM-M-549-2017. 3. Learned counsel for the State, on instructions from SI Naseeb Singh, could not deny the fact that the petitioner is not the owner of the vehicle from which the cows are stated to have been recovered and otherwise his case is not different from Junaid, as also Chand @ Chanva @ Chan, who also been admitted to bail by a co-ordinate Bench vide an order dated 18.12.2016, passed in CRM-M-44603-2016. 4. Considering the above and the fact that the trial is not likely to conclude in the near future and in any case two similarly placed co-accused have already been granted bail, this petition is allowed. The petitioner shall be admitted to bail upon his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial Court further subject to any condition that would be laid down by that Court.
