JUDGMENT : 1. The petitioner, who is serving as Incharge District Youth Services and Sports Officer, Jammu, has been transferred and posted as Incharge District Youth Services and Sports Officer, Budgam vide Order No. 59-Edu (YSS) of 2017 dated 16.06.2017. The petitioner is aggrieved of the aforesaid order on the ground that the same has not been issued to sub-serve the interest of administration which has been passed only to accommodate Smt. Chanchal Kour-respondent No. 3, who is holding the lower post of Incharge Zonal Physical Education Officer, Moughla, Rajouri. 2. I have perused the order. Sofar as the petitioner is concerned, he is working as Incharge District Youth Services and Sports Officer, therefore, in terms of Rule 27 of the J&K Civil Services Regulations, a person can be posted anywhere on the post of his cadre. Therefore, there is no infirmity in the order impugned. As the petitioner is only transferred from the post of Incharge District Youth Services and Sports Officer, Jammu to the post of Incharge District Youth Services and Sports Officer, Budgam, therefore, there is nothing wrong with the order. Sofar as respondent No. 3 is concerned, she has been transferred from the post of Incharge Zonal Physical Education Officer, Moughla, Rajouri and posted in Jammu to look after the work of District Youth Services and Sports Officer, Jammu in her own pay and grade which respondents have done in the interest of administration. 3. In view of the above, there is no merit in this petition which is dismissed. 4. However, in view of the submissions made by the petitioner at Bar that his son is suffering from fracture in right thigh and that it would be very inconvenient for the petitioner to join at Budgam keeping in view the law and order situation there, the petitioner is given liberty to make representation to the respondents highlighting therein all these aspects, which if received by the respondents, shall be disposed of by passing appropriate orders.
