JUDGMENT : Heard Mr. A.R. Sikdar, learned counsel for the writ petitioners. Also heard Mr. Ravi Sharma, learned Standing Counsel, Secondary Education Department, Assam appearing on behalf of respondent Nos.1, 2 and 3 whereas Mr. B. Gogoi, learned Standing Counsel, Finance Department, appears for respondent Nos.4 and 5. 2. The petitioner No.1 claims to have been appointed as a Hindi Teacher (Junior Grade) on 10.03.1993 whereas the petitioner No.2 claims to have been appointed as a Hindi Teacher (Junior Grade) on 01.11.1993. Both the petitioners were originally appointed in the scale of pay of Rs.1185-2395/- per month. Originally, the salaries of both the petitioners were paid under a Centrally sponsored scheme. However, subsequently when the Central Government had discontinued the scheme, the posts were permanently retained by the State Government of Assam against non-plan head and that is how the petitioners along with similarly situated Hindi Teachers were continued in service. Their grievance is that although they have been rendering their services continuously since the date of their appointment, yet, their salary and allowances have not been paid by the respondents on several occasions during the intermittent period, thereby causing undue harassment to the petitioners. 3. Mr. Sarma, learned departmental counsel, submits that this Court has already disposed of similar writ petitions with a direction upon the department to examine the claim of the petitioners and take appropriate action in the matter and the present writ petition also can be disposed of in the same line. 4. Having heard the leaned counsel for both the parties this writ petition is disposed of by permitting the petitioners to make a representation before the respondent No.2 within two weeks from today ventilating their grievances. If the representations, as permitted by this Court, are made by the petitioners individually, within the timeframe mentioned above, the same will be duly considered by the respondent No.2 and if on proper examination of their claims, it is found that the petitioners had been performing their duties as Hindi Teachers during the period in which their salaries have not been paid, then, in that event, appropriate orders be passed within four weeks thereafter, for payment of salary and allowances to the petitioners as per the provisions of the Rules. 5. The writ petition stands disposed of accordingly.
