JUDGMENT : 1. Vide Advertisement Notification No. 03 of 2014 dated 30th December, 2014, respondent No. 3 invited applications for making selection amongst others for 161 posts of Junior Staff Nurses Divisional Cadre Jammu under different categories. As per Advertisement Notification, qualification for the post of Junior Staff Nurse is 10+2 with Diploma in Nursing from a recognized Institute. 2. The petitioner claims that she being eligible, responded to the aforesaid Notification and sought consideration for the post of Junior Staff Nurse Divisional Cadre, Jammu under ST category. The petitioner participated in the selection process and ultimately on the conclusion of the selection process, select list was issued in which the petitioner was shown at S. No. 1 under ST category. It is further submitted that after the issuance of select list, respondent No. 3 vide his communication dated 18th November, 2016, forwarded the select list to respondent No. 1, who in turn submitted the recommendations to respondent No. 2 vide letter No. ME/NG/44/2012 dated 13th February, 2017 with a direction to issue formal orders of appointment in favour of the selected candidates. 3. Grievance of the petitioner is that despite there being recommendations made by the Jammu and Kashmir Service Selection Board and duly forwarded by respondent No. 1 to respondent No. 2, respondent No. 2 has not issued the order of appointment in favour of the petitioner. She, therefore, submits that on inquiry, she was told that there are few candidates, who have been working on contractual basis as Junior Staff Nurse, have filed different writ petitions in which there are orders of status quo. The petitioner has referred two writ petitions, i.e., SWP No. 2532/2016 titled Nancy Kumari Bhat v. State of J&K and ors and SWP No. 2512/2015 titled Abhishek Sharma. vs. State of J&K and ors. The petitioner submits that she has gone through the contents of the writ petitions aforesaid, which do not pertain to the challenge to the selection in which the petitioner has been selected. She has relied upon the judgment passed by this Court on 17.05.2017 in SWP No. 1178/2017 titled Moni Jasrotia vs. State of J&K and ors and has submitted that the case of the petitioner falls within the four corners of the orders of this Court and a direction needs to be issued to respondent No. 2 to issue appointment order in favour of the petitioner. 4.
4. Heard learned counsel for the petitioner and also perused the record, particularly the judgment passed by this Court on 17.05.2017 in SWP No. 1178/2017. 5. In view of the short controversy involved in the petition and the issue being covered by the judgment of a Coordinate Bench, i.e., 17.05.2017, this petition is disposed of at this stage by directing respondent No. 2 to consider the recommendations made by respondent No. 3 in favour of the petitioner for her appointment as Junior Staff Nurse Divisional Cadre Jammu under ST category, within a period of one month from the date of receipt of copy of this order by the respondents. Needless to say that the petitioner would be entitled to order of appointment provided there is no legal impediment and there are no specific directions by this Court to the contrary. 6. With these observations, the writ petition is disposed of along with connected MPs.
