JUDGMENT : Kurian Joseph, J. Heard learned counsel for the parties. 2. We are not inclined to interfere with the finding in the impugned order dated 05.05.2006 passed by the High Court of Calcutta. Admittedly, the respondent has been continuing as a tenant ever since 1965. Therefore, the High Court is right in holding that The West Bengal Premises Tenancy Act, 1956 would apply. 3. The appeal is hence dismissed. 4. However, it is made clear that in case the appellant initiates proceedings for eviction under the provisions of The West Bengal Premises Tenancy Act, 1956 before the competent Authority, in view of the prolonged litigation, we direct the Authority concerned to dispose of the petition expeditiously and in any case within six months from the date of institution of the petition. 5. Pending applications, if any, shall stand disposed of. 6. There shall be no orders as to costs.
